This Legal Agreement between you and PSA governs your use of the store and service (the “Service”).
The PSA provides here a selection of recorded squash events, highlights, and other content (“Products”) available from our online store (“Store”). The service provided by the Store, including the Products and the video player, and any other features, tools, applications, materials or other services offered from time to time by the PSA are referred collectively as the "Service".
You agree that you will pay for all Products through the Store, and that PSA may charge your credit card or debit card for any Products purchased. You are responsible for the timely payment of all fees and for providing PSA with a valid credit card or debit card.
Your total price will include the price of the Products plus any applicable VAT (in effect on the day of download).
You have the right to withdraw from your transaction without charge and without giving any reason until delivery of a Product has started. You do not have the right to withdraw from a transaction once delivery of a Product has started at which point your transaction is final. The Store’s services commence immediately when you begin to download a Product from the Store and you will not have a right to cancel your contract once the download commences unless you have received an unacceptably poor download. If this happens, you must tell us as soon as possible, and if the poor download is caused by PSA and cannot be resolved, a refund may be provided.
Use of Information
You can visit the Website without disclosing any information about yourself. PSA do not collect personal identifying information when you access the Website homepage and browse the Website without disclosing your personal data (except Cookies; see below under "Cookies"). However, to purchase any Products from the Store, or participate in any contest or message feature, vote in polls or otherwise express an opinion, you must register and provide accurate information about yourself to the Website. The types of information that may be collected on at these pages include: your name, e-mail address, postal address, and telephone/mobile number, your gender and date of birth ("Personal Information"). We request these details in order to provide the Service to you (i.e. dispatch news and PSA communications via email, post, fax or phone), to respond to any queries you may have, to ensure we request and receive the correct consent from you, and to understand customer trends and patterns. Your Personal Information is password protected, and any Personal Information you provide to the Website is protected from unauthorised disclosure by reasonable technological measures. Personal Information is not, however, transmitted via SSL encryption technology. We recommend that you do not divulge your password to anyone.

PSA reserves the right, at any time, to modify these conditions by posting a revised version on the Website. You acknowledge that you have read and understood (and agree to be bound by) these conditions now and every time you purchase any Products. By continuing to purchase Products you accept any revised version.
1. Electronic Contracting
Your use of the Store includes the ability to enter into agreements and/or to make transactions electronically. You acknowledge that your electronic submissions constitute your agreement and intent to be bound by and to pay for such agreements and transactions. Your agreement and intent to be bound by electronic submissions applies to all records relating to all transactions you enter into on this site, including notices of cancellation, policies, contracts and applications. In order to access and retain your electronic records, you may be required to have certain hardware and software, which are your sole responsibility.
2. Requirements for use of the Service
The Service is available to you anywhere in the world.
Use of the Service requires compatible devices, internet access, and certain software (fees may apply); may require periodic updates; and may be affected by the performance of these factors. High-speed Internet access is strongly recommended for regular use and is required.
3. Your Purchase
In order to purchase and download PSA Products from the Store, you must enter your name, address and email to which the Products will be sent. You agree to provide accurate and complete information when purchase Products. You agree that PSA may store and use the information you provide.
4. Price and Payment
Our prices only cover purchase of Products. Telephone line and other communications or access costs may be charged to you separately by your ISP or relevant service provider. All our prices are inclusive of EU VAT at the rates in force from time to time. Except in the case of manifest error, the prices payable for the Products that you order are as set out on the Website at the time at which you place your order.
Payment for Products must be made through Sage Pay and payment must be made in accordance with their conditions. You confirm that the credit/debit card which you use will be yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer.
PSA reserves the right to refuse credit/debit card payments in its reasonable discretion.
5. Use of Purchased Product
You agree that the Products are provided to you by way of a personal licence only. You understand that the Service and certain Products include a security framework using technology that protects digital information and limits your use of Products to certain usage rules and you shall use Products in compliance with the applicable usage rules established by PSA (“Usage Rules”), and that any other use of the PSA Products may constitute a copyright infringement. Any security technology is an inseparable part of the Products. PSA reserves the right to modify the Usage Rules for future purchases on the Service at any time. However, such changes will not apply to Products that you have already purchased. Any change to the Usage Rules will be communicated to you. In the event that you refuse to accept the new Usage Rules, you will no longer be able to acquire Products from the Service.
Usage Rules. You agree that you will:
(a) use the Service for non-commercial purposes only without making any gain and that you will not permit any other person or persons to use the Service. This means, for example, that you must not charge for viewing of the Products and that you cannot use the Products to attract others to buy goods or Services from you or anyone else;
(b) never permit any other person to access the Products nor will you transmit, give or copy to or assist or permit any third party in accessing or making a copy of any Product.;
(c) not view the Products in circumstances where members of the public can view them simultaneously or authorise, enable or procure any other person to do so; and
(d) not abuse this Website or use it for any unlawful or unauthorised purpose (which includes transmitting any computer viruses through the site, or using the site in a manner which violates or infringes the rights of anyone else).
6. Content Security
You agree not to violate, circumvent, reverse-engineer, decompile, disassemble, or otherwise tamper with any element of the Security Framework—or to attempt or assist another person to do so. Notwithstanding any other provisions, you are allowed to burn Products to CD, within the limits of the Usage Rules. The Usage Rules may be controlled and monitored by PSA for compliance purposes, and PSA reserves the right to enforce the Usage Rules without notice to you.
7. Service Security
You agree not to access the Service by any means other than through use of software provided by PSA for accessing the Service. You agree not to modify the software that is provided by PSA to access the Service in any manner or form, or to use modified versions of the software, for any purposes including obtaining unauthorised access to the Service. Violations of system or network security may result in civil or criminal liability.
8. Duration and Termination
Our right to terminate.PSA may terminate this agreement with immediate effect and by written notice at any time if you commit a material breach of this agreement (and any breach of clauses 4, 5 or 6 will be considered to be a material breach) or if you do not fulfil any of the technical requirements set out in clause 9.
9. The Service and Service Availability
You are responsible for ensuring that you have and maintain all the hardware and software necessary to access, receive and view the Service.
In the event that PSA reasonably determines that you do not meet these requirements PSA reserves the right to refuse the provision of the Service to you. In such a case you will be entitled to a refund of any sums paid ("Our right to terminate").
PSA will provide the Service with reasonable care and skill. PSA does not make any other promises or warranties about the Service and in particular does not warrant that:
(i) your use of the Service will be uninterrupted or error-free. You agree that from time to time PSA may remove the Service for indefinite periods of time, or cancel the Service at any time for technical or operational reasons and will, to the extent practicable, notify you of this;
(ii) the Service will be free from loss, corruption, attack, viruses, interference, hacking, or other security intrusion which shall be events of Force Majeure, and PSA disclaims any liability relating thereto. You shall be responsible for backing up your own system, including any Products purchased from the Service.
In particular, the image and sound quality of the Service may vary, whether due to congestion on the internet or telephone lines or otherwise. The Website may not be uninterrupted, timely, secure or error-free.
From time to time we will need to close the Website to carry out upgrades or maintenance. We will try to keep this to a minimum. Subject to the constraints described above, PSA will provide the Service with reasonable care and skill. Apart from this PSA make no representation or warranty (and exclude all warranties and conditions otherwise implied, to the fullest extent permitted by law).
This does not affect any other statutory rights you may have as a consumer.

In all instances, please be ready to give your e-mail, order reference, product details, postcode which PSA will require from you in order to identify your purchase.

Any notice given by PSA can be given by post or email to the most recent postal or email address we hold for you. Transmission or postal failures are at your risk, and we cannot be responsible for non-receipt of messages we send you.
Unless agreed otherwise in writing, the maximum liability of PSA to you arising by reason of or in connection with the sale of Products to you shall be limited to the amount paid by you in respect of the Products in question ("payment amount") PSA shall in any event be liable to you for:
(i) any direct loss in excess of the subscription amount; or
(ii) any corruption to data or any indirect or consequential loss whatsoever even if it has been advised of the possibility of such loss or should reasonably know of such loss.
12. Data Protection
It is good practice, and it is your responsibility, to take adequate steps to protect against viruses and such like. The information and data ("personal data") which is provided by you in connection with this site will be held on the computers and manual records of, and will be used by, PSA and sponsors, affiliates, official suppliers and any other reputable suppliers of goods and services which PSA believe may be of interest to you (together "the companies"). A complete list of all such companies is available on request from the address below.
The personal data shall be used by the companies for the following purposes:
(i) to update and develop the companies' records and for assessment and analysis including market and product analysis;
(ii) to assist the companies in offering and providing their services/products to you;
(iii) to enable the companies to review, develop and improve the services offered by them. The companies may inform you from time to time by email, telephone, or mail about relevant news, information, promotions, services and products offered by any of them which they believe may be of interest to you. If you do not wish this to happen, please ensure that you untick the appropriate box when you register your personal details. By law you are entitled, upon payment of a fee, to receive a copy of information or data about you which is held by any of the companies. You are also entitled to require the rectification, erasure or blocking or any such information or data which is inaccurate or not up-to-date and held by the companies. If you wish to exercise any of these rights, or if you wish to opt-out of any future processing of your information or data held by the companies, please write to the address below stating your full name and address and providing any other relevant information.
13. Force Majeure
PSA shall have no liability to you for any delay or failure to deliver the Service to the extent that such delay or failure to deliver arises from causes beyond the reasonable control of PSA including, but not limited to, the failure of electronic or mechanical equipment or communication lines, third party action (including denial of service attack and overuse or misuse of the Service), telephone or other inter connect problems, computer viruses, unauthorised access, theft, operator errors, fire, severe weather conditions, including floods, acts of God, acts or regulations of any regulatory, governmental or supranational authority, war, riot, strike, lock-out, industrial disputes and the cancellation or postponement.
No waiver by PSA shall be construed as a waiver of any rights or remedies, or any subsequent breach of any provision of these Conditions.
15. Entire Agreement
These Conditions together with the current Service and Product prices and contact details on this Website, set out the whole of the agreement between you and PSA. This agreement cannot be changed or terminated orally, and no changes or amendments to this agreement shall be binding upon the parties until confirmed in writing by PSA.
PSA employees or agents are not authorised to make any representations concerning the Service unless confirmed in writing by PSA. You confirm that you do not rely on, and waive any claims for breach of, any such representations that are not so confirmed.
16. Third Party Rights
(a) Clauses 11, 12, and 13 of these Conditions confer a benefit on PSA and are intended to be enforceable by PSA by virtue of the Contracts (Rights of Third Parties) Act 1999.
(b) Except as provided in clause 16(a), a person who is not a party to the contract governed by these Conditions has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of these Conditions but this does not affect any right or remedy of a third party which exists or is available apart from that Act.
17. Governing Law
These Conditions shall be exclusively governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.

Since SquashTV Shop is offering non-tangible irrevocable goods we do not issue refunds for any digital media files or services purchased. If the purchased Digital Media File does not play or has other Media defects, please Contact SquashTV Shop within 10 days of purchase. Licensee's exclusive remedy hereunder shall be a replacement of the media file(s).
If the purchased Physical Media, i.e. DVD , or other physical media, does not function or has other Media defects, please contact SquashTV Shop within 30 days of purchase. Licensee's exclusive remedy hereunder shall be a replacement of the physical media.
